Amazon's consumer rights for Prime Day

With the arrival of Amazon Prime Day 2022, the discount marathon organized by the ecommerce giant reserved for users of the Amazon Prime fast delivery service which will start at midnight on Tuesday 12 July, millions of users are already preparing for the offers that will come, or that in some cases are already starting to show up. It is likely that several people will want to create a Prime subscription, taking advantage of the first free month to enjoy the discounts and then cancel the subscription before the first payment. It is therefore useful to review the legal framework of consumer protection with which Amazon operates.

What is the legal guarantee? How long does the legal guarantee last? Does it apply to everyone? So what if I get a defective product? How do returns work? Prime Day is over. How can I cancel my subscription? What is the Legal Guarantee? Provided by two European directives of 2019, the legal guarantee is the tool that protects consumers in the event that the purchased goods present lack of conformity with the sales contract. These lack of conformity arise when there are differences between the characteristics attributed to a product when it is presented to the consumer and the characteristics that the product has when the consumer comes into contact with us. In practice, if the product that arrives at home does not correspond to the description made of it on Amazon, it is not suitable for the use for which it is intended, it is not delivered with the accessories provided or is otherwise different from what is written on the sales contract, we can enforce the legal guarantee.

However, it should be noted that if at the time of purchase we are warned that a particular feature of the product we are going to buy differs from the description provided, and we proceed with the transaction anyway, we cannot enforce the Legal Guarantee in relation to this characteristic.

How long does the legal guarantee last? The legal guarantee covers defects that appear within 24 months of delivery. It is therefore always advisable to keep the purchase receipt and the documents confirming the shipment and delivery of the goods. Furthermore, with some exceptions for products for which this hypothesis is incompatible with the nature of the product or the nature of the defect, it is assumed that the lack of conformity that occurs within one year from the date of delivery of the goods already existed on that date.

It is also good to specify that any action aimed at asserting conformity defects must be concluded within 26 months from the delivery of the goods.

Does it apply to everyone? The legal guarantee is up to the consumer only, that is, to those who buy goods for non-professional purposes. The consumer can enforce the Guarantee both against Amazon if he buys directly from Amazon, and against other sellers if he buys from third parties on the site's Marketplace.

So, what to do if I get a defective product? If I get a product that has a lack of conformity, the best thing to do is to contact Amazon Customer Service. According to the regulation, I have the right to choose to receive the repair or replacement of the good, as long as the chosen remedy is not impossible due to disproportionate costs for the seller. Instead, I can ask for a proportional reduction in the price or the termination of the contract if the repair or replacement of the goods is not possible or is not carried out successfully.

The Amazon Customer Service operators will assist me, and if the problem I encountered arises from a lack of conformity, a case will be opened in my name and I will be assigned a code for repair or free replacement of defective goods under warranty.

How do returns work? Returns under warranty must be made within 30 days from the notification of dispatch of the replacement good. To do so, you need to enter the order number of the product on the page of the Amazon Returns Center, print a return label from the same page and proceed with the shipment.

Prime Day is over. What if I'm not satisfied with the service? If I have activated the Amazon Prime trial period just to be able to participate in Prime Day, I still have the option to cancel it before the first payment. In fact, terminating any subscription at prime is a matter of a few clicks, starting from the "Unsubscribe" button on the site's unsubscribe page and follow the instructions below. The procedure will also be further simplified under pressure from the European Commission, which believes that the current cancellation system does not comply with the European regulation on the protection of consumer rights, and has therefore asked the company to implement a system that allows cancellation in only two clicks.
