Sued Rome website must destroy all Nintendo titles

It is well known how strict Nintendo is against all forms of copyright infringement. Soundtrack enthusiasts have been following the ups and downs on YouTube for years when Nintendo music disappears without a trace and corresponding accounts lose their entire contingent of videos.

It should come as no surprise to anyone that you are at the gaming giant neither does the Rome website RomUniverse endorse it. A verdict was passed in May and the operator Matthew Storman was sentenced to a fine and the removal of all Nintendo titles. Now there are new findings in the RomUniverse case.

Nintendo demands the destruction of all relevant titles

The preliminary injunction originally requested by Nintendo was initially rejected by the court, but Nintendo asked for a new assessment. Judge Consuelo Marshall gave in to this, because Storman had announced shortly after the previous judgment that he wanted to start again with RomUniverse.

This is why Nintendo feared that Storman would put the Japanese company's titles online again and thus provoke another lawsuit. One wants to prevent this with an injunction. The fact that Storman announced the return of RomUniverse without Nintendo games did not change the assessment and the subsequent judgment.

The new judgment therefore states that Storman is not allowed to copy, offer or copy Nintendo titles for sale. In addition, the accused must now also "permanently destroy all unauthorized Nintendo games or other unauthorized copies of Nintendo's intellectual property including films, books and music". Storman has until August 17, 2021, otherwise he will have to answer in court again.
